Judges, Money and Politics: The State of Judicial Elections in Minnesota

As a result of recent U.S Supreme Court decisions, the election of state judges is becoming more partisan and expensive. Some fear that Minnesota’s courts are in danger of becoming a battleground of big-money campaign contributors and partisan operatives. To head off this possibility, reformers have proposed to change the process of electing judges in Minnesota to maintain an impartial judiciary. Leading experts and observers of Minnesota judicial elections assessed the risk of partisan elections and whether reform is justified.

Panelists included Gary Borgendale, local ministry director for AM980 KKMS radio, Eric Magnuson, former Chief Justice of the Minnesota Supreme Court, Sarah Walker, Chief Operating Officer at 180 Degrees, Inc., and Greg Wersal, attorney in private practice. The event was moderated by Professor Larry Jacobs.

Gary Borgendale

Gary Borgendale is the local ministry director at Salem Communications local affiliate AM 980 KKMS Radio, a Christian teaching and talk radio station. Mr. Borgendale works closely with local Christian ministries and churches helping them use radio to deliver their message to the community. Mr. Borgendale is also a leader in building numerous grassroots organizations including: Minnesota Faith and Freedom Coalition, Minnesota for Marriage, Minnesotans for Life and Americans for Marriage. Previous business experience includes sales, marketing and planning positions for small and fortune 500 companies. Mr. Borgendale holds an MBA from the University of St. Thomas and a B.A. degree from the University of Minnesota. 

Eric Magnuson

Eric Magnuson is the former Chief Justice of the Minnesota Supreme Court. Currently, Mr. Magnuson works in Briggs and Morgan’s Business Litigation Section and the firm’s Appellate Practice Group. After graduating cum laude from William Mitchell College of Law in 1976, Mr. Magnuson clerked for the Chief Justice of the Minnesota Supreme Court, the Honorable Robert J. Sheran. He has focused almost exclusively in the state and federal appellate courts for more than 25 years, and he is regarded as one of the most effective and respected appellate lawyers in Minnesota and the 8th Circuit. He also is a fellow and past president of the American Academy of Appellate Lawyers, and a longtime member of the American Bar Association, serving as co-chair of the Appellate Practice Committee of the Section on Litigation and in the same capacity for the Appellate Advocacy Committee of the Tort Trial and Insurance Practice Section. He was named the 21st Chief Justice of the Minnesota Supreme Court in June 2008, and served until 2010.

Sarah Walker

Sarah Walker is the Chief Operating Officer at 180 Degrees, Inc. Although on sabbatical, Ms. Walker is a doctoral student in the department of political science at the University of Minnesota. Her previous positions include Research Consultant at the Council on Crime and Justice, Director of Workforce Development at the Center for Court Innovation, Executive Director of the Youth Justice Funding Collaborative, and interim Research Director at the Council on Crime and Justice.

Greg Wersal

Greg Wersal grew up on his family's farm in southwestern Minnesota near Redwood Falls. Mr. Wersal graduated from St. John's University (summa cum laude) in 1977 and the University of Minnesota Law School (cum laude) in 1980. For the last 30 years, Mr. Wersal has been in the private practice of law in Golden Valley and Belle Plaine, Minnesota. He is best known for his work on judicial elections which resulted in a decision by the U.S. Supreme Court (The Republican Party of Minnesota v. White). Mr. Wersal recently ran in the election for a seat on the Minnesota Supreme Court.
